Terms & Conditions

The following Terms and Conditions have been prepared for memberships and classes at “Soulmates Yoga”.


1. Interpretation and variation

1.1 In the Terms & Conditions the following definitions apply:


Company/Studio: SOULMATES YOGA, Trade License No. 1181771 (hereinafter known as "The Company/The Studio"), a corporation organized and existing under the laws of the UAE, with its head office located at: Creek Gate Tower 1, Dubai Creek Harbour


Member/Studio Customer: any person that has signed a Registration Form at the Studio or via Mindbody/Class Pass/Lifemost online applications which has been accepted by the Company.

 

Registration Form: registration & application form signed by each Member/Studio Customer in-person or online.


Website: www.soulmates-studio.me or affiliated websites.

1.2 The Terms & Conditions are incorporated into the Registration Form & online booking system.

1.3 The Company reserves right to vary or revoke any of the Terms & Conditions which it may consider necessary or suitable for the regulation of the governance of the Studio & the conduct of Members. Any changes made will be announced to the existing Members.

1.4 The Terms & Conditions shall be governed by the laws of United Arab Emirates & subject to the exclusive jurisdiction of UAE.


2. Member/Studio Customer


2.1 Subject to condition 2.2, when a person has signed a physical or online Registration Form or accepted the terms & conditions online they shall become a Member of the Studio or a Studio Customer.

2.2 Acceptance of a person as a Member or a Studio Customer is at the discretion of the Company.

2.3 The Company reserves right to withdraw, suspend or refuse to renew membership of any Member or Studio Customer whose conduct is, or may deemed to be in the Company's reasonable opinion, injurious to the character of the Studio or amounts to a breach of the Terms & Conditions or where such expulsion is otherwise to be in the interests of the other Members of the Studio. Any Member so expelled shall forfeit all privileges to membership & shall not be entitled to any refund for any period during which his membership is suspended.


2.4 The Studio may run promotional introductory offers. The following is to be announced on the Studio’s website and social media platforms.

 

3. Terms of the Agreement

 

3.1 Health-Related Risks and Studio Customer’s Limitations: Studio Customer assumes full responsibility for any health-related risks that he or she may encounter during the class. It is incumbent upon Studio Customer to proactively announce his or her physical limitations or conditions to the instructor prior to joining the class. This proactive approach aims to ensure a safe and tailored experience for all participants.

3.2 Age Limitations and Requirements: Studio Customers must be 15 years of age to participate in any of the offered classes. If a Studio Customer is 15, 16 or 17 years of age, they must come with a parent or guardian to attend class. If a Studio Customer is 18 years of age or older, they do not need to attend with a parent or guardian.

3.3 Classroom CCTV for Security Purpose: For the purpose of ensuring the safety and security of all individuals present within the premises, The Company shall install and maintain closed-circuit television (CCTV) cameras in the classrooms. These CCTV cameras will be utilized exclusively for security purposes and to monitor the overall well-being of the premises. The Company shall take all reasonable measures to ensure that the privacy of individuals is respected and that the captured footage is used solely for security-related matters.

3.4 Class availability for Female and Male Studio Customers: Most of classes offered at the Studio are available for Studio Customers of all genders. However, the Studio offers special class sessions that are available for Ladies Only. Class availability details are published by the Studio on the official website and Company’s social media pages.

4. Wavier of Recovery

 

4.1 In consideration of the compensation and benefits provided under this Agreement, Studio Customers hereby waives and releases any and all rights to recovery from The Company for any injuries, damages, losses, or liabilities that Studio Customers may sustain or incur while participating in services provided under this Agreement. The Studio Customers acknowledges that he or she assumes all risks associated with the services provided and hereby agrees to indemnify and hold The Company harmless from any claims, demands, actions, or proceedings brought against The Company by any third party in relation to such injuries, damages, losses, or liabilities. This waiver of recovery shall extend to all claims arising from negligence, strict liability, breach of contract, or any other legal theory, whether known or unknown, arising out of or related to the performance of services under this Agreement. This waiver shall be binding upon Studio Customers, its heirs, successors, assigns, and legal representatives.

5. Liability

 

5.1 By signing up and joining any class, Studio Customer recognizes that exercise requires physical exertion, which may be strenuous and may cause physical injury, and should be fully aware of the risks and hazards involved.

 

5.2 By participating in a chosen class, Studio Customer understands that it is his or her responsibility to consult a physician prior to and regarding participation in the offered classes, health programs or workshops offered by instructor, substitute instructor or studio administrator. By signing up for a class, Studio Customer declares that he or she is physically fit and has no medical condition, which would prevent his or her full participation in these classes, health programs or workshops.

 

5.3 If a Studio Customer is pregnant, by joining a class, she declares that she participates fully at her own risk and that of her unborn child/children.

 

5.4 In consideration of being permitted to participate in the yoga classes, health programs or workshops, Studio Customer agrees to assume full responsibility for any risks, injuries or damages, known or unknown, which he or she might incur as a result of participating in the chosen programs.

 

5.5 In further consideration of being permitted to participate in the yoga classes, health programs or workshops, Studio Customer knowingly, voluntarily and expressly waives any claim he or she may have against the instructor or substitute instructor for injury or damages that he or she may sustain as a result of participating in these programs.

 

5.6 By joining a class, Studio Customer declares to understand that from time to time during class, the instructor may physically adjust students form and posture. If Studio Customer does not wish for such physical adjustments, he or she should inform the instructor at the beginning of each class he or she decides to attend. Studio Customer also acknowledges that if he or she wishes to receive such adjustments, it is his or her responsibility to inform the instructor when an adjustment has gone as far as he or she desires at that time.

 

5.7  Studio Customer takes full and sole responsibility for any liability of loss or damage to personal property associated with classes or any other events.

 

5.8 Studio Customer declares that he or she understands that he or she must cancel a booking a minimum of 12 hours prior to the start of class to avoid a deduction from the package. If he or she holds an unlimited membership, a day will be deducted from it.


5.9 Studio Customer will never engage Soulmates Yoga, the instructors, or any of the supporting staff, in legal proceedings relating to possible damages in whatever form, that may be the result of participation a chosen class.


5.10 Soulmates Yoga offers the following guidelines to diminish the risk of injury:
⁃ Studio Customer should consult with a physician before signing up and joining a selected class
⁃ If Studio Customer has an injury, or other physical issue, he or she should inform the instructor before the class
⁃ Studio Customer should listen to and follow the guidance of the instructor
⁃ Studio Customer should be conservative when exercising and listen to his or her physical limitations
⁃ Studio Customer should not perform any exercises that are painful
⁃ Studio Customer should ask for clarifications, if he or she does not understand an exercise.


5.11 This Waiver of Liability includes, without limitation, injuries which may occur as a result of (a) use of any equipment or facilities which may malfunction or break, (b) negligent instruction or supervision by the instructor, (c) slipping and falling while in the facility or on the premises.

6. Code of Conduct

6.1 Studio Customers shall adhere to Soulmates Yoga’s code of conduct at all times:
⁃ Wear clean, comfortable clothing during the attended class
⁃ It is advised not to eat later than 1 hour prior to the beginning of class

⁃ No shoes are allowed to be brought into the classroom

- No food items are allowed to be brought into the classroom

- No dangerous items such as: aerosol cans, matches/lighters, weapons/replicas, any items that are illegal to possess or carry are allowed to be brought into the classroom

⁃ Phones should be turned off/put on flight mode at any time during the class
⁃ Studio provides yoga mats and needed equipment for use during the classes
⁃ Studio Customers should arrive at least 10 minutes before the beginning of the class

- If a Studio Customers arrives later than 5 minutes from the beginning of the class, her or she will not be allowed to attend the class
 

6.2 Soulmates Yoga reserves the right, at its discretion, to deny Studio Customer entry to the Studio and terminate his or her Membership, if her or she does not adhere to the code of conduct as set forth in article 7.1, or do otherwise disturb the peace, without reimbursing any already paid fees.

 

7. Studio Opening Times and Class Schedule

7.1 Details of class times at the Studio may vary. Class times are published by the Studio on the official website as well as Mindbody, Class Pass and Lifemost applications.

8. Payment Terms


8.1 Details of class prices and memberships are available on the Studio’s website or Company’s pages on Mindbody, Class Pass and Lifemost applications.


8.2 Subject to any statutory right of cancellation, payments for classes, monthly subscription fees & annual payments are made non-refundable unless otherwise stated in the Terms & Conditions.


8.3 Workshops, Retreats & Special Programs at the Studio are non-refundable. They can be credited to account if notice is given with a minimum of 2 days prior to the workshop date due to unforeseen circumstances (exceptions made for certain medical/ personal circumstances at The Company’s discretion). Deposits however are non-refundable.

 

8.4 Certain refund requests for class packages may be considered by the Company on a case-by-case basis and granted at the sole discretion of the Company.

 

8.5 Studio Customer must cancel a booking a minimum of 12 hours prior to the start of class to avoid a deduction from the package. If he or she holds an unlimited membership, a day will be deducted from it.


9. Personal Data


9.1 Soulmates Yoga collects personal data of the Studio Customers in order to keep record of its members and for exercising of payment order. Soulmates Yoga shall be careful while collecting these data and will always comply with the applicable Data Protection act.


9.2 Soulmates Yoga will use Studio Customer’s personal data as mentioned in clause 8.1 to keep Studio Customer informed about the Studio’s activities, and possible changes in the class schedule. If the Studio Customer does not want to receive any communication from Soulmates Yoga, he or she can opt-out by sending e-mail to: info@soulmates-studio.me. The Studio Customer is informed that in such a case he or she may not be able to make use of all Soulmates Yoga services and products.


9.3 All details that Studio Customers share with Soulmates Yoga, not only personal data but also private and health related information is honored in its private nature and handled with highest care and protection of this information.

 

9.4 The Studio is entitled to use the Studio visitors' photos and videos of Studio's classes or events for the company's advertising purposes. Should the Studio Customer object to this, he or she should mention it prior to attending a class or event organized by the Studio.


10. Applicable Law, Dispute Resolution, Prevailing Language


10.1 It is the intention of the parties to this Agreement that this Agreement and the performance under this Agreement, and all suits and special proceedings under this Agreement, be construed in accordance with and under and pursuant to the laws of the State of UNITED ARAB EMIRATES and that, in any action, special proceeding or other proceeding that may be brought arising out of, in connection with, or by reason of this Agreement, the laws of the State of UNITED ARAB EMIRATES shall be applicable and shall govern to the exclusion of the law of any other forum, without regard to the jurisdiction in which any action or special proceeding may be instituted.

All disputes with respect to this agreement shall be under the jurisdiction of DUBAI Courts.


10.2 In case of complaints, please send an e-mail to info@soulmates-studio.me. The complaint will be handled with care and protection of privacy of the complaining party. Also, the complaint will be archived and stays retrievable for a period of 1 year from the first contact.

10.3 All class instructions and guidance will be provided to Studio Customers in English language.

11. Copyright


11.1 All Soulmates Yoga materials are under copyright protection of Soulmates Yoga and cannot be reproduced by any other party without permission of the author. Failure to comply may result in legal action. This includes both the course schedule, content posted on social media and any other shared materials.
